DMCA Policy

At MoverArt, we respect the intellectual property rights of others and expect our users to do the same. Our policy is to respond to any alleged copyright infringements and take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws.

DMCA Takedown Notice Procedure

If you believe that material or content residing on or accessible through our website, http://moverart.com, infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Agent listed below:

  1. Identification of the Work: A clear description of the copyrighted work that you claim has been infringed.
  2. Identification of the Infringement: A detailed description of where the material that you claim is infringing is located on the MoverArt website, with enough detail that we may find it on the website.
  3. Contact Information: Your address, telephone number, and, if available, an e-mail address at which you may be contacted.
  4. Statement of Good Faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature: Your physical or electronic signature.

Counter Notices

If you believe your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice containing the following information to the Designated Agent:

  1. Identification of the Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  2. Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Contact Information: Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court in [Your location], and a statement that you will accept service of process from the person who provided the DMCA notification or an agent of such person.
  4. Signature: Your physical or electronic signature.

Once a counter-notice is received by the Designated Agent, MoverArt may send a copy of the counter-notice to the original complaining party informing them that MoverArt may replace the removed material or cease disabling it in 10 business days.

Repeat Infringers

In accordance with Section 512(i)(1)(a) of the DMCA, MoverArt will, in appropriate circumstances, disable and/or terminate the accounts of users who are repeat infringers.
